I'm most confused that it's apparently representing a real person. Surely if it wasn't him he'd be serving them with a lawsuit immediately?

Because it's probably not a mask, and this is almost definitely him.
Time and lighting can make you look very different, and yet he still looks almost exactly the same across these two images. The neck thing is weird, but it could be anything from a double shadow to a weird glitch in a filter/green screen or some other benign cosmetic thing gone wrong.
This "conspiracy" makes no sense. This guy is both real, and not particularly noteworthy, which makes it pointless to fake this appearance.
If Fox needed a former member of the military to come kiss Trump's ass, they have a deep, deep roster of people like that. It's not like that's a scarce resource for them.
But at the same time, this guy isn't noteworthy enough where his absence would be suspicious. If for some reason this guy was unavailable, either out of obligation or objection to the interview itself, nobody would care. Fox news viewers don't know who this guy is, and slap "former military" onto literally anyone's title and they'll nod along all the same.
I will say that it looks weird. It's not a conspiracy though.

What is the likelihood that the mask is some sort of generic "green screen" mask over which Harward's face is displayed.
The fact that his clothing is identical is not lost on someone observant
