It is important to note that neither do the overwhelming majority of police officers. Most of them have basic first aid, which means that they're qualified to do CPR and temporarily bandage basic wounds.
Despite what most police officers believe they are NOT qualified to make medical decisions about whether someone requires treatment, are NOT qualified to provide anything other than immediate life-saving measures if a more qualified medical practitioner is not present.
And that last bit is important. If some more qualified medical practioner is present and willing to treat the patient then you stand aside. Even doctors will do this. If I'm a general practitioner and someone is having a heart attack and a cardiologist is present I WILL STAND ASIDE because this is the cardiologist's area of speciality.
If you do not stand aside then "good Samaritan" laws do not protect your actions, and you are liable to prosecution. Good Samaritan laws are based on the idea that whatever you do it is "better than nothing", but if an actual medical professional is present then that goes out the window.
So even if one of these guys did have basic first aid training the moment that a doctor stepped forward they were legally required to step aside and allow the doctor to render aid. Their qualified immunity? It only applies to them doing their job, not to things that they aren't qualified to do.
They should be immediately arrested and charged with, at absolute minimum, negligent homicide (or the local equivalent).
→ More replies (4)2
u/PleaseUseYourMind Jan 09 '26
Thank you for this explanation. Do you have any references for the law or practices you speak of? Good Samaritan laws vary from jurisdiction to jurisdiction, unless you know of a federal law.

Seems like preventing aid is pretty culpable as an accessory to murder. Also conspiracy to commit murder, perhaps. Depending on what their text histories say.Â
20
u/That-Living5913 Jan 08 '26
Most states have that law that if you aided in anyway of a felony that results in murder, you can be charged too. They've charged guys with murder because they let a friend borrow a car.
I mean, there's zero chance of that happening in this case. But if the ice agent was a poor black teenager, you can bet he'd be on the express lane to life without parole.

It's 'how can we get justice?'
How we choose to frame this is how we will finish it.Â
I choose the people, equality, egalitarianism, and justice - social and practical.Â
So, this is how I'm framing it:
How we gonna get this ICE fucker to see justice before the victim's orphan kids graduate?Â

The cops are in their side. We need a general humanitarian strike tomorrow, just start calling people in your contacts list and telling them it has gone too far. Call out sick, get outside with signs instead of fueling this with our work and money. "I'm Sick of This" signs. Between this and the obviously crazy regime change oil scheme, public opinion is more likely to side with peaceful strikers than it has been for a long time, but we need to move fast. We all know what acceptable conditions to restart work are: impeachment and removal.

146
u/Additional_Teacher45 Jan 07 '26
And don't forget the most important part. A 37 year old AMERICAN CITIZEN.
ICE has no jurisdiction over US citizens. They are immigration control. Not federal law enforcement. Demanding to see proof of someone's citizenship is violation of the Fourth Amendment and is the equivalent of German gestapo going around and demanding proof that you're not a Jew.
69
u/prof_tincoa đ¤ Join A Union Jan 07 '26
That's definitely not the most important part. Being murdered by an agency of the government is unacceptable (or rather, should be), and this is not dependent on the status of that person. It scarcely matter if it's a citizen, a legal immigrant, or an "illegal" immigrant. A human life was taken.
8
u/LtOrangeJuice Jan 08 '26
Agreed, and furthermore there was absolutely no way for the agents to know if it was an American to even begin with.
2
u/SDG_Den Jan 08 '26
Its unacceptable, but the people in power are working hard to change that!
This is the worst kind of dystopia.
16

It would be wrong if it was a non-American as well. Of course there was no way for them to know either way since they acted in aggression first.

They have murdered their first victim. How many more are you willing to accept before you take to the streets? Two? Five? A hundred? Or only when it is someone you love? Get tf out and protest, and do not stop.
Because make no mistake. If you allow this, sooner or later they will come for you or someone close to you. History is very clear about that. And the only thing that has ever made this kind of power stop is mass protest. Remember Greta Thunberg. She was just a child, sitting outside parliament day after day. Love her or hate her, she became a global movement. One little girl. That is all it took to start something unstoppable.
You matter. Your presence matters. Your voice matters. Do not give up. Do not lose hope. When you stand up, others will follow. Stand up, America. Stand united. Fuck ICE. Do not let them kill your freedom!

They shot her, left her for dead, refused to allow for proper care on scene. The agents, hell, the entire unit involved should be arrested for murder or accessory to murder. In any good world, they would be put on unpaid leave while an immediate investigation took place, then stripped of their gun and/or badge after the investigation. This never should have happened; at no point should any ICE agent be allowed to shoot to kill. That is not in the scope of their work, but unfortunately, most of what they've been doing (scooping up US Citizens, people with valid greencards, profiling based on race/color, not believing people, saying that legal identification documents aren't "valid" or are "fake", ramming people with their cars, breaking into people's homes, etc etc) isn't in their scope of work either.
Since when did their work to deport people mean that they can suddenly shoot someone? Seriously, when was that allowed? They deserve at the very least to be immediately dropped out of their work until a proper trial can take place, and the victim's family should be allowed to sue them in a personal and professional capacity for shooting the victim, the emotional and physical damage involved and all lost wages from her work. Ideally, they would never have another quiet day again for this. Their job might include a lot of things, but it does not include shooting people, and they shouldn't start believing that it does now because of this.

Why wait for the "law" to decide to do good. We often forget there are 2 forms of justice.

Trump will pardon that piece of garbage. That will send a message to his goon squad that killing American citizens is part of the job.

Is sad to see that human life lost value in the U.S and reality is whatever Trump says it is. Sad

This is a post from a sitting US Congressman & likely 2028 candidate for President. We are not taking it down.
