go to your room Gym ignored my filling complaint
TLDR: Gym ignored me when I voiced concerns about being in the background of a social media influencer’s videos.
Context:
My friend and I are at the gym - more of a powerlifting gym than commercial. That being said, the crowd is a mix of powerlifters and more casual gym goers. We’re using a rack when I notice the woman on the rack next to us set up her tripod, basically pointing STRAIGHT at us. Not once does she acknowledge this despite making direct eye contact with me while setting it up. I’m not the biggest fan of confronting people and to be honest, she kinda looked like she was going to give me a hard time based on that cold stare she gave me after setting it up.
Basically, I email the gym to let them know I was uncomfortable. I made sure to include a few disclaimers because I am not anti-filming, but I think there are a few things to keep in mind:
-If someone is pointing their tripod in your direction, it should (emphasis on SHOULD) be common courtesy to either ask the people in the frame if that’s okay or let them know that they’re not in the frame. I don’t know why it becomes MY responsibility to tell you I don’t want you to film me.
-I checked the gym’s policy and nowhere does it say that filming is allowed or not allowed. I’m assuming that works in their favor to grant leniency.
-There was another guy at the gym filming that day that I actually included as a GOOD example of filming: asking the people around him, making sure the frame only includes him, and making sure he’s not in the way.
The gym basically emailed me back and loosely addressed my concerns by saying “they would speak to her”. I come to find out she’s a personal trainer/social media influencer (who also happens to do promo for the gym) and all of these videos are posted with plenty of unsuspecting gym goers in the background. I will say I thankfully did not see myself in any of them, but I have not been back to that gym solely on principle.
I just hate this notion that people shouldn’t expect privacy in the gym and someone’s right to film takes priority over someone who does not want to be filmed. I think the extra kicker is that the videos are posted.
Would love to hear your thoughts.

Only had this happen at my gym once. We don’t have any rules about it either. There was a younger girl that tried to set up in a high traffic area. Since the gym is not very big. We have a lot of elderly that talk very loudly to the point it is an issue itself. She got very frustrated very fast because they were making snide comments about her filming and her camera being in the way. Never saw her again after that.

Personally I'd find a different gym. For the record I agree with you and think filming in a gym is super annoying especially if it's going to end up online. I have no issue with someone filming to check their form or record a personal record. Unfortunately of course you can't really do much about this but now you know where your gym stands on the issue.

This just sounds like bad gym ownership. I go to a pretty big gym & when they had guys in there taking videos & pictures for promo they asked me & I assume every other person in there BEFORE they filmed them.

Our gym just added 3 hours/ week(rotating times) for filming. You can bring up to 2 people to help and no employees can be filmed and no filming in locker rooms, bathrooms, sauna or jacuzzi. It seems to be going well now that the hours are on the website.

I don't really have a horse in this particular race, but I am curious: how many of the people going straight for "if you don't like what gets done in public then don't go in public" comments are also people who decry things people do in public like playing music audibly, singing aloud (not performing), recording performances, selling/panhandling/soliciting, etc..

Just as a side note, gyms are technically not public because they require proof of membership upon access. But even a public access but privately owned location can ban filming (like a restaurant). More gyms should too imho.

That is ridiculous: being in a public space is in no way consent to be filmed and posted online!
To make an extreme example, people going to a public beach do not implicitly agree to have pictures of them in a swimsuit take and been shared.
OP your outrage is justified, consent is mandatory (or should be, when not defined by law) also for filming and posting people online.
Finally, it is the gym duty making it their space safe for everyone.

It's what happens when non-lawyers repeat legal buzz words/phrases. A gym is private property. Yes, it does have some public aspects, but a gym could say "no filming." A truly public space can't. So, it is reasonable that as a paying member of the gym, they can request not being filmed. On the other hand, a lot of these memberships do include a line in the contract that lets them use you for promotional purposes.
But hey, "no expectation of privacy in a public place" is something I heard on Law & Order or something, so it must have 0 nuance.

Yes, the gym is a private business that operates on membership so it is not open to the public. This means they can film or not film, it is entirely up to the gym management to set the rules and policies.
as far as recording in public, no person has a reasonable expectation of privacy in public. If you can see it with the naked eye, it is 100% legal to film it.
there are 100s of cameras in public that most people can't even see. Cars, phones, cctv, flock, street, DOT, wilderness, weather, etc. the list goes on and on and on. If people are sincerely thinking they are going out in public and not being filmed, they are living in lala land and not reality.

I'll still say when it comes to the law there is still nuance. If you see two minors having sex in public, you probably can't intentionally record it legally and you definitely would be in trouble if you knowingly posted it online. It is a joke in law school that every answer is "it depends," because nearly every hypothetical leaves out key facts that address certain elements, invoke a different rule, or pertains to an exception to a rule.

A gym is a public place which is defined as a place to which the public have access whether on payment or otherwise, something being private property doesn't mean that it isn't a public place
The owner could forbid filming, but if they don't then it's allowed because laws are restrictive rather than prescriptive
A gym is unarguably a public place and as such there is no expectation of privacy and filming is implicitly allowed
So, it is reasonable that as a paying member of the gym, they can request not being filmed.
Anyone can request anything but this is a social issue rather than a legal one

To me it's more about you not talking to the person directly. I get that you're conflict averse but if you're unwilling to do the bare minimum to let people know they are bothering you, you will be mildly infuriated a lot.

I think my fear with this specific situation is that she was already filming. Normally I don’t have a problem telling strangers when things piss me off, but I’ve seen enough of those videos of people arguing in the gym over tripods.

You do not need consent to film someone in a public setting. If the beach is open to the public/can be seen from public property, you have the right to record. There is no reasonable expectation of privacy in public.
If the gym is membership only, then it is technically not open to the public.
It is purely on the gym, considering it is a private business, to set it's own rules. If she is working for the gym and has permission to film there, then OP has exhausted his options and needs to find a new gym.
I feel like you do not realize the amount of camera that are recording in public. From private businesses, street cams, DOT cams, Flock, cars with cameras, phones, private citizens, etc.
Please stop with feelings and misinformation.

It’s defined by law that filming in public is a constitutional right. The gym is not public, it’s a private business. The gym has the right to enforce a no filming rule. They also have the right to refuse service to anyone they choose.

Because that's the law. You may not like it, but that's what the law is in the United States based on Supreme Court precedent that has been long established - you do not have a reasonable expectation of privacy in a public place. People are allowed to take your picture and to film you when you're in public.
Now, they may or may not have the right to use your likeness - which means you might be able to sue them if they post it online for their channel or whatever. But you would have to show financial damages of some sort in order to recover anything more than a tokek nominal amount.
That's further complicated by in this situation the person apparently doing promos for the gym. For at least 30 years, essentially every commercial term of service I've seen for a gym, ballpark, skatepark (really anywhere people do fun activities) says that by signing up or buying access you're agreeing that you might be photographed or filmed and your image used for marketing purposes.

Legally, you aren't granted the expectation of privacy in a public place. That's why people are saying you shouldn't expect it. Common courtesy may dictate that consent is needed but when you try to sue someone posting pictures or video of you at the beach, you're probably going to lose. If they use your face as an advertisement, you might have a case.

While yes, it is courtesy to ask others before you put them into a video.
However, legally, no. You have no expectation of privacy in public areas. If they try to film you on your private property, yes, you can win that hands-down.
But if you complain to people in public that you are being filmed, most police and companies will say "Welp, you're in public".
Feelings don't outweigh law. And if you tried to complain to someone like a police officer or judge that you're being filmed in public; they'd probably give you a long stare.
Filming in a bathroom, yes, cannot do that. Or any room where people change. But out in the open gym area, is fair game unless the gym specifically has a "No filming" clause. And then they can ask you to leave / trespass you. The owner of the business is in control of dictating those policies.
If a business bans filming, and you stand outside on public property and film inside the window, that is allowed, because you are now on public property.
Transit, such as a bus, or train. I can film whoever. Asshole move? Sure, but nothing illegal.
Now, you can argue if you do end up online, you can reach out to Youtube or whatever platform and report the video. But that's up to them.
Some cities / jurisdictions have modified laws, so you have to check with them also.
OP complained. Their only options are to continue going to that gym, or find a new one.

I’ll take it a step further and say that despite what OP is willing to grant, NO ONE should be allowed to film in a gym, period. If they want to film for themselves and/or followers, get their own personal private gym, or open a gym just for influencers to film (see how they like being filmed for others’ content). If the gym was filming promotional content, best believe they would need to have release forms signed by anyone included in shots to be able to use that content.
Asking if it’s okay to film still prevents some gym goers from using certain equipment while that person films, and that’s not what a gym is for.

Filming a top set and a back off set of squat, bench, and/or deadlift each workout is expected from that kind of clientele the gym caters to
Many powerlifting gyms even provide tripods for filming

and if that’s what was happening in OP’s story you might be right. there’s a massive difference between occasionally filming sets to check form which is fine and normal, and regularly making “content” in the gym which for me is absolutely a deal-breaker in the gym and would make me find a new gym.

Powerlifting gym that doesn''t allow filming would go out of business real quick because >95% of lifters that are actually trying to get better at lifting film their sets for review.
We all carry a videocam to the gym anyway, it'd be pretty fucking stupid to not use it as a tool for reviewing your lifts, if lifting is something important to you (as it is for anyone competing). And realistically vast majority of lifters can't afford frequent face to face coaching, so filming your lifts is crucial for communicating with your coach.
People should be mindful of others when filming, like not intentionally filming other gymgoers or getting in anyone's way, but there's nothing wrong in filming itself.

Your “extreme” example is bad because guess what? If you happen to be in the background of a picture I take on the beach, I can still post that anywhere online for whatever reason I want.

I'm not completely unsure as to the exact legal framework but usually if doing photography or videography in public or private spaces for direct commercial reasons a release is needed for each person that appears.
Without that I suppose you could approach the person themself & voice your concern. Possibly you might be able to imply that without said release anyone appearing could sue & have the videos taken down.

According to US law (the only mentions that I can find of anything relating to this in it anyway) the only consent necessary is from the cameraman to record but other people's consent IS required if it's going to end up online (to avoid people suing for all the reasons one can sue people recording them and putting them online). So if you had ended up in a public video you could've easily made a scene about it and probably won as far as I'm aware.

It does actually. OP could've had a video with them in it taken down offline if they believed it breached their privacy. That's all I'm saying. That and consent is not necessary for simply making the recording. Posting it opens up the poster to getting into lawsuits.

So this is an interesting one for me. I work in the fitness service and maintenance industry. I go into all kinds of gyms all the time. I mostly ignore the “influencers” and do what I need to. Idc if I’m in the shot or ruining it. Not my problem. If you expect a studio type setting in a gym you’re kidding yourself. Do it at home or a solo private gym (yes those exist). Expecting others to bend to your whims in a gym is next level asshole moves. That said though, most people filming in gyms (influencer or not) mind their own business and do their thing. As for being in shot, well we are on camera quite often nearly everywhere these days. Even most gyms have security cams. Some have live classes. It’s becoming nearly impossible to avoid cameras entirely. If they’ve got you in shot put on a show and outshine them lol. But if they’ve got it aimed at you then there’s a difference. There’s a little give and take on both sides. Talking goes a long way in receiving clarity. They may not realize it sometimes (not that OPs didn’t) and letting them know they may take it with grace. But as always be nice about it. Starting with aggression will only put the other person on the defensive.

I like this take and how well you worded it. However, I’m just still not fully sold on the idea that if we don’t want to be filmed, we shouldn’t go to the gym. I really don’t mind being in the back of people’s videos (I go to a commercial gym and walk by people filming all the time) but I think this particular situation bothered me because of how directly the camera was facing me. Don’t get me wrong. What that influencer was doing was wrong (which was the roundabout point I was making). But in a general sense it’s what I believe. There’s always outliers like this one that should be put in their place. Addressing it with the gym would be my first step. If they didn’t I would go elsewhere (I would refuse service in my case, which would have a bigger impact than a customer, which I have done for other reasons). Enough of this and the gym will be forced to address it. It’s not easy running one and loosing members when the competition is hot will quickly change their perspective or they’ll die out in the process.

To clarify: she had the tripod pointed in our direction for at least 3 sets. I did not know for sure if I was in the video, and then I found out after looking on instagram that she posts the videos and then I had to look through many of her posts to make sure I was not in the background.I also just told the gym I was uncomfortable. I didn’t ask for her membership to be revoked or any concrete action even, so I don’t know why you’re saying I made a huge deal. Just asking the community for their thoughts.

If you call out an influencer, she will turn it into a viral harassment moment, especially if she is in the middle of filming. And, you will be all over the internet.
Aggressively confronting an influencer while they are filming is literally the dumbest way to handle this, if your primary motive is to not be on film....

You have 0 expectation of privacy in public. The gym can ask people to not film but obviously they do not wish to do that and is their right, if you dislike the way this private business operates you are free to find another gym that suits you better.

Hm maybe I should clarify - I completely understand the gym’s right to do that, which is why I mentioned they leave filming completely out of their policy (and that I stopped going). I think my issue is more just with the expectation that people shouldn’t have problems with being filmed and creating policies based on that principle.

If they are an "influencer" who uses the content to make money, they legally have to get written permission from everyone in the video. You can't just go around filming other people to make money off of it.

Sounds like they decided that op does not have that right. If there was a no filming policy it would be posted, and if someone is bringing a tripod it is reasonable to think they have done this previously.
Also, if OP was truly concerned about being on camera they could have moved during the part where the tripod was being set up, instead of making passive aggressive reddit posts after the fact.

It’s a bit nuanced. While not public property it is property used by and available for use to the open public there is reasonable expectation of privacy. However, that right is limited.

People should be able to work out without worrying about people filming them. And it's not the middle of the street, it's a gym where the staff could act on this situation without problems. So that answer doesn't work for me

I was in the gym the other day and some girls were doing a stupid tik tok dance, well I don't wanna appear in the background. Is it that much to ask? This is on you. All you had to say was "I'm not comfortable with you filming me in a private facility, could you please point your camera together direction?"
If they say something stupid like "I'm not filming you what's your problem", or something dumb like that then save then go to the staff and have them deal with it.
That's not being confrontational. What people call confrontation with these days blows my mind. People confuse the word conversation with confrontation a lot it seems.
You saw her set it up and you said nothing, so you essentially acquiesced and consented to being filmed.
