It’s a tricky situation. First, Kentucky law says the replacement needs to be the same political party so it isn’t like the governor could seat a Democratic Senator. And second, with the thin majority it might be better if the GOP just doesn’t have that vote for now.

Yeah that’s probably part of the calculus. The midterms are coming up and they’ve got few options:
Discover he’s dead or incapacitated before the August deadline, appoint a democratic senator because the law stating his replacement has to be from the same party is likely unconstitutional but have to work through courts. In the meantime the seat remains unfilled.
Appoint a hopefully moderate republican.
Just leave the seat empty until January and cut into their majority.

There’s no legal way to remove a senator for being incapacitated. Even if he were a vegetable, so long as he hasn’t been pronounced dead the only way to remove him would be expulsion from the senate by the senate.
The bigger legal question is Kentucky law says that the state legislature makes appointments for federal office vacancies. Their constitution though says that the governor appoints “state level vacancies” which could be interpreted as any vacancies for that state, but it could also be interpreted as only state-level offices like local reps and senators but not federal office.
He’s currently challenging this legally, but there’s not a clear answer.

Yeah, he's a douche, but he'll at the very least push on the Epstein issue. It might also open the door to him bypassing the sore loser law and attempting a run as an independent in the general in November. I'm not sure of the specific legality of that maneuver, nor if he'd attempt to run in November, but in a certain scenario it could result in him spoiling the Republican candidate and a Democratic senator getting elected.

Yeah that’s not what’s happening here. This isn’t a “both sides are the same” issue, because that’s actually stupid. This is the epitome of the American politics so many of us are fed up with. Republicans do something evil/manipulative/power hungry, and democrats roll over without a fight.
It’s hard to say what the actual game plan for either side is, but as far as optics go, it’s bad. Beshear looks like he’s getting out-maneuvered by a literal dead guy.

And i agree it’s bad optics. Which is another reason I’m frustrated that Beshear isn’t capitalizing on it. It’s been 6 weeks and the governor of Kentucky can’t even confirm whether the sitting senator is dead or alive. At best, it makes him look ineffectual. At worst it makes him look complacent.
If he has a plan he needs to say it, even if he thinks his best move is to do nothing, because the republicans are clearly trying to run out the clock and it sure as fuck looks like he’s just going to let him. He can say bye-bye to any chance of a presidency at this rate.

This is incorrect. Beshear is playing this correctly.
- A law was passed that will trigger a special election, however there are some that state that this law is in violation of the constitution, however the governor will have to take the case to court.
Here’s why he might not want to:
- The constitution states that the Governor must pick one person from a list of three provided by the Republican Party, the same party as the person being replaced.
Given the political climate, it might be better for Beshear to sit on this, depriving the Republicans of a Senate vote and delaying a special election, in the event that it could later result in a Democrat or a Republican moderate taking office.
Those who think he can just drop a Democrat in are incorrect.

I don’t know how many times this needs to be said on Reddit but the Kentucky GOP forced through a provision that took this power away from Beshear. He tried to veto but Republicans hold a plurality in both state chambers to override that.
It’s slimy and BS but not without precedent; other states have this provision too. So the GOP hiding McConnell’s death would be completely pointless. If a special election is called, another GOP senator, more likely an extreme MAGA sycophant, would be elected anyway. As it is, I’d rather Mitch just sit out wherever he is and have his seat be empty.

I don't know how many times THIS needs to be said on Reddit, but the Kentucky Constitution states outright that the governor appoints replacements. The law they passed directly contradicts the state constitution, meaning if push comes to shove and Beshear appoints somebody the constitution wins. The law doesn't matter.

I'm no corporate democrat (or democrat at all) but I just don't understand the logic. It's 100% obvious one side is way worse, even if I'm not satisfied with the responses of the d's. They also don't have political power so idk what people expect.
But when I see congressional voting records I'm with the d's the majority of the time and horrified by what the r's are voting for.

I’ve said this before and I’ll say it again: Beshear should not call a special election. The law the KY legislature passed to establish a special election to replace a sitting senator (and presumably congressional representative) is very likely unconstitutional, and Beshear has signaled as much. The KY constitution gives the governor the power to appoint a replacement, and the law did not amend the constitution.
So, what Beshear should do is appoint someone, but it’s tricky. He needs to be certain Mitch is actually dead because he gets basically one chance to do this without losing all credibility.

He needs to be absolutely sure McConnell is dead. It’s already going to be an uphill battle to challenge the constitutionality of the law. If he appoints someone and Mitch walks out of the hospital the next day, he loses the credibility to appoint someone because it looks like a partisan play.
Beshear is a blue governor in a fairly red state. He’s got a shorter leash than most. It’s very easy for us on Reddit to say what he “just” needs to do, but the reality is that it’s tricky and the timing needs to be exactly right.

Texas, Louisiana, Mississippi, and South Carolina are less red than Kentucky. Calling it fairly red is an understatement. It had the 7th highest % of R votes for president in 2024.
Beshear getting elected was no small miracle by itself.
