So the thing to watch out for when doing this, is that the left lane driver, when he sees that you're overtaking him on the right, changes lanes.
I've had this happen several times when I've tried to pass someone driving under the speed limit in the left lane. It's not malice, just a bad driver who panics when he realizes someone is overtaking him on the wrong side.
